The legal battle between Nigerian afrobeats musician, David Adeleke, better known as Davido, and his ex-girlfriend and baby mama, Sophia Momodu, for joint custody of their nine-year-old daughter may soon be over after the singer suggested he may quit the lawsuit following comments in a counter-affidavit by the latter.
In the counter-affidavit, filed under SUIT NO: LD/1587PMC/2024, Sophia Momodu claimed Davido is an unfit father to care for their daughter, as can be seen from his history of carelessness in taking care of children.
Item 76 in the document states that a sad case of child negligence occurred in Davido’s house that resulted in the death of his son; a reference to the death of Davido and Chioma’s son, Ifeanyi, in 2022.
She states that no mother in her right senses would agree to have her young girl’s child custody given or shared with such characters in such an unsafe environment.

Following the release of the counter-affidavit, Davido made a post to his X account addressing the situation. He said that Sophia is constantly bringing up the passing of his child at any point, reminding him of the tragedy that still haunts him. Davido also said that his daughter will grow up and know that her father fought for her and for now, Sophia can have her.

“Your constantly bringing up the death of my child at any point you can to just remind us of this tragedy that haunts us every day of our lives,” the singer wrote on X.
The legal battle between Davido and Sophia Momodu
Davido took legal action against Sophia Momodu in June 2024 seeking joint custody of their daughter.
He claimed to have been responsible for her education, housing, transportation, living expenses, health care, and periodic travel in his court filing.
In response, Momodu filed to counter him, asserting that since their relationship ended in July 2022, Davido has neither contacted their child nor provided emotional or financial support. She said that Davido has not seen their daughter since July 2022 by his own choice and pointed out that she has never prevented him from visiting their daughter.
Davido seeks joint custody that would allow both parents to make decisions together and ensure that their daughter spends equal time with each parent. In contrast, Sophia Momodu is seeking sole custody, which would grant her full legal and physical control over their daughter’s upbringing, with Davido having visitation rights.
From his recent posts on X, it seems Davido will grant Sophia the sole custody of their daughter following the allegations she made against him in the court documents.
He wrote, “All I ask for is JOINT CUSTODY !! And nothing else! But cus it’s ‘Davido’ yall wanna act like y’all can’t read. Smh .. I’m off this! Yall be blessed and I pray this never happens to you.
“Joint custody – Both parents will have access to the child. Sole custody – Only a single parent will have access to the child.”
